1. INTRODUCTION & LEGAL STATUS
Welcome to Delights of Turkish ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of delightsofturkish.com (the "Website") and the services we provide, including online Turkish tutoring and learning materials (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
Changes to Terms: We reserve the right to modify these Terms at any time. Material changes will be notified via email to your registered address at least 14 days before taking effect. Continued use of the Services after such changes constitutes acceptance of the new Terms.
Language: These Terms are written in English. In the event of any dispute regarding the interpretation of these Terms, the English language version shall prevail.
2. DESCRIPTION OF SERVICES & AI DISCLOSURE
Delights of Turkish provides personalized online Turkish language tutoring and digital learning resources.
AI-Assisted Content: We utilize Artificial Intelligence (AI) tools to assist in the generation of educational materials, such as vocabulary lists, sample sentences, and interactive exercises.
Disclaimer: While all AI-assisted materials are reviewed, edited, and curated by a human tutor for educational and linguistic accuracy, we do not guarantee that the content is 100% free of errors or nuances. Use of these materials is at the student's own risk.
Third-Party Links: The Services may contain links to third-party websites or resources (such as external learning materials or video content). These links are provided for convenience only. We have no control over the content, privacy practices, or availability of such third-party sites and accept no responsibility or liability for them. Accessing third-party links is entirely at your own risk.
3. ELIGIBILITY & USER ACCOUNTS
Age Requirement: Our Services are exclusively available to individuals who are 18 years of age or older. We do not offer our Services to minors under any circumstances. By registering, you represent that you are at least 18 years old.
Account Responsibility: You are responsible for maintaining the confidentiality of your credentials. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
Account Sharing: Your account is strictly for your personal use. You may not share your login credentials, purchased credits, or access to digital materials with any third party. We reserve the right to suspend accounts suspected of unauthorized sharing or simultaneous logins from multiple locations.
4. PAYMENTS & CREDIT SYSTEM
Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders. Paddle handles payment-related inquiries, local tax compliance (VAT/GST), and processing.
- ✦Credit System: All services and content are purchased using a simple credit system where $1 equals 1 credit. The credit cost for each lesson or digital item is always clearly displayed before you book.
- ✦One-Time Purchases: You may purchase credits as a one-time payment, in the amount of your choosing.
- ✦Monthly Subscription: We also offer an optional monthly subscription plan. Subscribing authorizes a recurring monthly charge of $100 USD to your selected payment method via Paddle, until cancelled. Each successful monthly payment adds 100 credits to your account balance.
- Credit Rollover: Unused subscription credits roll over month to month with no limit on how much can accumulate. To help you keep track of your balance, we will send you a reminder email every 3 months summarizing your current credit balance and encouraging you to book lessons if you have a large unused balance.
- Cancellation: You may cancel your subscription at any time via your account settings or by contacting us. Upon cancellation, no further monthly charges will occur. Any credits already in your account balance at the time of cancellation remain valid and usable subject to the standard Credit Expiry rule described below.
- Price Changes: If we change the subscription price, we will notify all active subscribers by email at least 30 days before the new price takes effect. You may cancel your subscription at any time before the new price applies if you do not agree to the change. Continued subscription after the effective date constitutes acceptance of the new price.
- ✦Pricing & Taxes: Prices may be subject to VAT or local taxes depending on your jurisdiction, which will be calculated and collected by Paddle at checkout.
- ✦Credit Expiry: Credits expire if an account is inactive (no login or booking) for 365 continuous days. We will send a reminder email 30 days before credits are set to expire.
- ✦Refund Policy: You may request a monetary refund for any credits currently in your account balance at any time. Credits that have already been spent on a completed lesson or digital content are not refundable. For full details, please refer to our Refund Policy at delightsofturkish.com/refunds.
5. BOOKING, CANCELLATION & ATTENDANCE
- ✦Cancellation: You may cancel a lesson up to 12 hours before the start time for a full credit refund. Cancellations within 12 hours are non-refundable.
- ✦Rescheduling: Permitted up to 6 hours before the lesson. Requests within 6 hours are treated as a late cancellation.
- ✦Late Arrival: The tutor will wait for 15 minutes. If the student does not arrive, the lesson is forfeited with no refund.
- ✦Tutor Absence: If the tutor cannot attend a lesson due to an emergency or illness, the student will be notified at the earliest possible time, and the credit will be fully restored to the student's account for rescheduling.
- ✦Note: We are not responsible for technical issues on the student's side. If the tutor experiences a failure, the credit will be restored.
6. INTELLECTUAL PROPERTY & UGC
All original content, designs, and brand elements are the exclusive property of Delights of Turkish. Purchasing a lesson grants you a personal, non-transferable license for private study only. Reproduction, distribution, or commercial use is strictly prohibited.
User-Generated Content: If you submit homework, comments, or other materials to the platform, you retain ownership of your content, but you grant us a license to use, store, and display it as necessary to provide the Services.
Feedback & Suggestions: Any feedback, ideas, or feature requests you provide to us are entirely voluntary. We may use such feedback to improve our Services without any obligation or compensation to you.
7. SERVICE CHANGES & TERMINATION
Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time. Material changes that affect existing credit balances will be communicated to affected users via email at least 14 days in advance.
Termination by Us: We may terminate your account for violations of these Terms, abusive behavior, or providing false information. In the event of termination for cause, no refund of unused credits will be issued. In the event of termination without cause by us, a prorated refund of unused, non-expired credits will be offered.
Termination by You: You may close your account at any time by contacting us at support@delightsofturkish.com. Upon closure, any unused, non-expired credits will be forfeited unless a refund is otherwise available under our Refund Policy.
8. USER CONDUCT & SESSION RECORDING
To maintain a professional and safe learning environment, students are expected to adhere to the following standards of conduct:
General Expectations
- Attend lessons in a quiet, private environment.
- Wear appropriate attire (professional/casual) during video calls.
- Ensure a stable internet connection for the duration of the session.
Strictly Prohibited
- Consumption of alcohol or illegal substances during lessons.
- Sharing screen or content that is NSFW, offensive, or illegal.
Zero Tolerance Policy
Immediate account termination without a refund will occur in cases of:
- Harassment & Abuse: Any form of verbal abuse, sexual harassment, threats, or intimidation directed at the tutor.
- Discrimination: Use of hateful, racist, or discriminatory language regarding religion, nationality, gender, or orientation.
Session Recording Policy
- By Us: We may record sessions for quality assurance, tutor improvement, and dispute resolution.
- By You: You may opt-in to have your lessons recorded for personal study via your account settings.
- Prohibition: Recording sessions via external software or devices without our explicit written permission is strictly prohibited. Unauthorized distribution or publishing of any session recordings (including those provided by us) will lead to immediate account termination and potential legal action.
9. LIMITATION OF LIABILITY & FORCE MAJEURE
Disclaimer of Warranties ("As-Is"):The Services are provided on an "AS-IS" and "AS-AVAILABLE" basis. We make no guarantees that the platform will be uninterrupted, error-free, or completely secure. Furthermore, while we strive for educational excellence, we do not guarantee specific learning outcomes, exam results, or language proficiency levels from the use of our Services.
Limitation of Liability: To the maximum extent permitted by law, our total liability shall not exceed the amount actually paid by you during the 12 months prior to the event giving rise to the claim.
Force Majeure: We shall not be liable for any failure or delay in performance resulting from forces beyond our control, including natural catastrophes, acts of God, strikes, war, or interruptions in telecommunications and utility services.
Indemnification: You agree to indemnify and hold us harmless from any claims or damages arising from your violation of these Terms or your use of the Services in an unlawful manner.
10. PRIVACY POLICY

11. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of the Republic of Türkiye. Disputes shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to the exclusive jurisdiction of the courts in Istanbul, Türkiye.
Consumer Rights Reservation: Nothing in these Terms limits or excludes any mandatory statutory rights you may have as a consumer under the laws of your country of residence that cannot be waived by contract.

12. MISCELLANEOUS PROVISIONS
Severability: If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that the Terms otherwise remain in full force.
Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us, superseding any prior written or oral understandings.
No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
